By downloading, installing, or using SwapHair AI ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app.

1. Description of Service

SwapHair AI is a mobile application that uses artificial intelligence to generate hairstyle previews based on photos you provide. The app also offers on-device hair color previews, face shape analysis, and beard style previews.

2. Eligibility

You must be at least 13 years old to use this app. By using the app, you represent that you meet this requirement.

3. User Content

• You retain all rights to photos you provide to the app.
• By uploading a photo, you grant us a limited, temporary license to process that image solely for generating your hairstyle preview. This license terminates immediately after processing.
• You represent that you have the right to use any photos you upload and that they do not violate any third party's rights.
• Generated hairstyle previews are for your personal, non-commercial use.

4. AI-Generated Content

Hairstyle previews are generated by artificial intelligence and are approximations only. Results may not accurately represent how a hairstyle will look in real life. We make no guarantees about the accuracy, realism, or suitability of any generated preview. Do not make permanent hair decisions based solely on AI-generated previews.

5. Subscriptions and Payments

• Free tier: New users receive a limited number of free hairstyle generations.
• SwapHair Pro: Premium subscription plans are available for unlimited generations and additional features.
• Subscriptions are billed through your Apple ID and managed by Apple. Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• No refunds will be provided for any unused portion of a subscription period. Refund requests must be directed to Apple.

6. Acceptable Use

You agree not to:

• Upload photos of other people without their consent
• Use the app to create misleading, deceptive, or harmful content
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Use the app for any unlawful purpose
• Circumvent any usage limits or security measures

7. Intellectual Property

The app, including its design, code, AI models, hairstyle templates, and branding, is owned by SwapHair AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app.

8. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The app will be uninterrupted or error-free
• AI-generated results will be accurate or satisfactory
• The app will be compatible with all devices or operating system versions

9. Limitation of Liability

To the maximum extent permitted by law, SwapHair AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to dissatisfaction with AI-generated results or hair decisions made based on app previews.

10. Termination

We reserve the right to suspend or terminate your access to the app at any time, for any reason, without notice. Upon termination, your right to use the app ceases immediately.

11. Changes to Terms

We may update these terms at any time. Continued use of the app after changes constitutes acceptance of the updated terms.

12. Apple's Standard EULA

These terms supplement Apple's Standard End User License Agreement (EULA) for licensed applications. In the event of any conflict, Apple's EULA takes precedence. Apple's EULA is available at apple.com/legal.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the United States.
